This is the fifteenth annual Marine Insurance Day Seminar, a collaborative effort of the American Institute of Marine Underwriters (AIMU), American Marine Insurance Forum (AMIF), Association of Average Adjusters of the U.S. and Canada, Inland Marine Underwriters Association (IMUA), and Marine and Insurance Claims Association (MICA). It is through our joint efforts that we can provide high quality educational seminar.

We will present a virtual event, live streaming presentations from more than ten industry experts. Interactive features (polls and chats) will be used to allow attendees ask questions in real time. The event will include trivia questions, prizes, and many opportunities for your engagement.

Peter Cridland will discuss the timely topic of “social inflation”, in which claims levels have increased in recent years. He will share factors which contribute to nuclear verdicts as well as “reptile theory” on the part of plaintiffs - estimated to have achieved an additional $10bn in awards in recent years. Cridland will explore defense strategies against this and highlight the need, in some cases, for the recruitment of specialty counsel when defending such cases.

MARINE INSURANCE AND COVID 19
COVID-19 hurts people, but does it cause “physical loss or damage” to the insured property? A discussion of the many thousands of litigations nationwide where courts are considering this hotly debated issue of whether property and marine cargo insurance policies provide coverage for multi-billion dollars in claimed COVID-19 losses.

Subrogation and Large/Complex Claims – Overview of the subrogation process, including case study on large/complex losses with significant recovery potential and early involvement of subrogation specialists / legal counsel in the claims handling process. Matters to be discussed include notices of claim, time limits for filing suit, joint survey procedures, preserving evidence and subrogation receipt language.

This marine topic on NTSB’s Most Wanted List (MWL) deserves attention following several tragic, high profile marine casualties. Passenger and fishing vessels present distinct safety challenges within the marine transportation industry. Mr. Turrell will highlight the transportation safety improvements needed to prevent accidents, reduce injuries, and save lives - and how marine insurers can contribute.

CHALLENGES FOR LARGE SHIP
The EVER-GIVEN Grounding – Insurance Considerations
Mr. Zeuner will provide a brief summary of the casualty, and will summarize the various exposures faced by the parties to the voyage. The presenter will then provide a brief overview of the various insurance considerations to be taken into account in this and similar casualties, including Hull & Machinery, Cargo, and P&I coverage. Principal allowances in General Average, including salvage will be discussed, as well as the role of the Average Adjuster.

Mr. Faulkner will explain the causes and effects of ship interaction when vessels are moving in confined or restricted waterways. There are also some short videos showing practical examples of how common interactions cause vessels to behave. Vessel interaction is a complex subject, but this short presentation will provide a background introduction to a very interesting topic.
